McKEVITT, GRAF -- read once and referred to the Committee on Energy AN ACT relating to the public awareness of the use and benefits of biofuel THE PEOPLE OF THE STATE OF NEW YORK, REPRESENTED IN SENATE AND ASSEM- BLY, DO ENACT AS FOLLOWS: 1 Section 1. 1. The New York state energy and research development 2 authority (NYSERDA) shall develop a program to increase the public's 3 awareness of the use and benefits of biofuel including, but not limited 4 to, an advertisement campaign of such benefits. 5 2. For purposes of this act: 6 a. "biofuel" shall mean a fuel which includes biodiesel, ethanol, and 7 agri-biodiesel or any other standard approved by NYSERDA; 8 b. "biodiesel" shall mean a fuel comprised exclusively of mono-alkyl 9 esters of long chain fatty acids derived from vegetable oils or animal 10 fats, designated B100, which meets the specifications of American Socie- 11 ty of Testing and Materials designation D 6751-02; 12 c. "ethanol" shall mean ethyl alcohol manufactured in the United 13 States and its territories and sold (i) for fuel use and which has been 14 rendered unfit for beverage use in a manner and which is produced at a 15 facility approved by the federal bureau of alcohol, tobacco, firearms 16 and explosives for the production of ethanol for fuel, or (ii) as dena- 17 tured ethanol used by blenders and refiners which has been rendered 18 unfit for beverage use; and 19 d. "agri-biodiesel" shall mean biodiesel derived solely from virgin 20 oils including, but not limited to, esters derived from virgin vegetable 21 oils from corn, soybeans, sunflower seeds, cottonseeds, canola, crambe, 22 grapeseeds, safflowers, flaxseeds, rice bran, mustard seeds and from 23 animal fats. 24 S 2.
