WRIGHT -- read once and referred to the Committee on Education AN ACT to amend the education law, in relation to the composition of the board of education of the city school district of the city of New York THE PEOPLE OF THE STATE OF NEW YORK, REPRESENTED IN SENATE AND ASSEM- BLY, DO ENACT AS FOLLOWS: 1 Section 1. Paragraph (a) of subdivision 1 of section 2590-b of the 2 education law, as amended by chapter 345 of the laws of 2009, is amended 3 to read as follows: 4 (a) The board of education of the city school district of the city of 5 New York is hereby continued. Such board of education shall consist of 6 thirteen appointed members: one member to be appointed by each borough 7 president of the city of New York; and [eight] FIVE members to be 8 appointed by the mayor of the city of New York; ONE MEMBER TO BE 9 APPOINTED BY THE COMPTROLLER OF THE CITY OF NEW YORK; ONE MEMBER TO BE 10 APPOINTED BY THE PUBLIC ADVOCATE OF THE CITY OF NEW YORK; AND ONE MEMBER 11 TO BE APPOINTED BY THE CITY COUNCIL SPEAKER OF THE CITY OF NEW YORK. 12 The chancellor shall serve as an ex-officio non-voting member of the 13 city board. The city board shall elect its own chairperson from among 14 its voting members. All thirteen appointed members shall serve [at the 15 pleasure of the appointing authority] A TERM OF THREE YEARS and shall 16 not be employed in any capacity by the city of New York, or a subdivi- 17 sion thereof, or the city board. TERMS OF MAYORAL APPOINTEES SHALL BE 18 STAGGERED. No appointed member of the city board shall also be a member, 19 officer, or employee of any public corporation, authority, or commission 20 where the mayor of the city of New York has a majority of the appoint- 21 ments. Each borough president's appointee shall be a resident of the 22 borough for which the borough president appointing him or her was 23 elected and shall be the parent of a child attending a public school 24 within the city school district of the city of New York. All parent 2 members shall be eligible to continue to serve on the city board for two 3 years following the conclusion of their child's attendance at a public 4 school within the city district. Any vacancy shall be filled by appoint- 5 ment by the appropriate appointing authority within ninety days of such 6 vacancy. Notwithstanding any provision of local law, the members of the 7 board shall not have staff, offices, or vehicles assigned to them or 8 receive compensation for their services, but shall be reimbursed for the 9 actual and necessary expenses incurred by them in the performance of 10 their duties. 11 S 2. This act shall take effect immediately; provided, however, that 12 the amendments made to section 2590-b of the education law by section 13 one of this act shall not affect the expiration of such subdivision and 14 shall be deemed expired therewith.
