  1 An Act relating to possession and use of certain handguns while
  2    hunting deer and including penalties.

  1  1    Section 1.  Section 481A.48, subsection 5, Code 2016, is
  1  2 amended to read as follows:
  1  3    5.  a.  The commission shall establish one or more pistol
  1  4 or revolver seasons for hunting deer as separate firearm
  1  5 seasons or to coincide with one or more other firearm deer
  1  6 hunting seasons. Any pistol or revolver firing a magnum
  1  7 three hundred fifty=seven thousandths of one inch caliber or
  1  8 larger, centerfire, straight wall ammunition propelling an
  1  9 expanding=type bullet is legal for hunting deer during the
  1 10 pistol or revolver seasons. The commission shall adopt rules
  1 11 to allow black powder pistols or revolvers for hunting deer.
  1 12 The rules shall not allow pistols or revolvers with shoulder
  1 13 stock or long=barrel modifications. The barrel length of a
  1 14 pistol or revolver used for deer hunting shall be at least four
  1 15 inches. The rules may limit types of ammunition. A person
  1 16 who is sixteen years of age or less shall not hunt deer with a
  1 17 pistol or revolver.
  1 18    b.  A person with a valid permit to carry weapons pursuant to
  1 19 section 724.7 may possess a pistol or revolver pursuant to that
  1 20 permit while hunting deer.  However, a person shall not use a
  1 21 pistol or revolver to hunt deer unless the pistol or revolver
  1 22 meets the requirements of paragraph "a" and the person has a
  1 23 valid hunting license with an unfilled tag that permits use of
  1 24 that pistol or revolver to hunt. 
  1 25    c.  A person possessing using a prohibited pistol or revolver
  1 26 while hunting to hunt deer in violation of this subsection
  1 27  commits a scheduled violation under section 805.8B, subsection
  1 28 3, paragraph "h", subparagraph (5).
  1 29    Sec. 2.  Section 805.8B, subsection 3, paragraph h,
  1 30 subparagraph (5), Code 2016, is amended to read as follows:
  1 31    (5)  Possession Use of a prohibited pistol or revolver
  1 32 while hunting to hunt deer, the scheduled fine is one hundred
  1 33 dollars.
  1 34                           EXPLANATION
  1 35 The inclusion of this explanation does not constitute agreement with
  2  1 the explanation's substance by the members of the general assembly.
  2  2    This bill amends Code section 481A.48(5) to provide that
  2  3 a person with a valid permit to carry weapons may possess a
  2  4 pistol or revolver pursuant to that permit while hunting deer.
  2  5 However, a person shall not use a pistol or revolver to hunt
  2  6 deer unless the pistol or revolver meets the specifications of
  2  7 the statute and the person has a valid hunting license with an
  2  8 unfilled tag that permits use of that pistol or revolver to
  2  9 hunt deer. A person using a pistol or revolver in violation of
  2 10 the bill's provisions commits a scheduled violation punishable
  2 11 with a fine of $100.
