| 3 | everything after the enacting clause with the following:

| 4 | "Section 5. The Expressway Camera Act is amended by | ||||||
| 5 | changing Sections 5 and 90 as follows:
| ||||||
| 6 | (605 ILCS 140/5)
| ||||||
| 7 | (Section scheduled to be repealed on July 1, 2023) | ||||||
| 8 | Sec. 5. Camera program. | ||||||
| 9 | (a) The Illinois State Police, the Illinois Department of
| ||||||
| 10 | Transportation, and the Illinois State Toll Highway Authority
| ||||||
| 11 | shall work together to conduct a program to increase the | ||||||
| 12 | amount
of cameras along expressways and the State highway | ||||||
| 13 | system in the counties of Boone, Bureau, Champaign, Cook, | ||||||
| 14 | DeKalb, DuPage, Grundy, Henry, Kane, Kendall, Lake, LaSalle, | ||||||
| 15 | Macon, Madison, McHenry, Morgan, Peoria, Rock Island, | ||||||
| 16 | Sangamon, St. Clair, Will, and Winnebago in Cook County. | ||||||

| 1 | (b) Images from the cameras may be used by any municipal | ||||||
| 2 | police department, county sheriff's office, State Police | ||||||
| 3 | officer, or other law enforcement agency with jurisdiction | ||||||
| 4 | over the expressway in Cook County in the investigation of any | ||||||
| 5 | offense involving the use of a firearm and to detect | ||||||
| 6 | expressway hazards. Images from the cameras shall not be used | ||||||
| 7 | to enforce petty offenses. | ||||||
| 8 | (c) Subject to appropriation, any funds needed to conduct | ||||||
| 9 | the program for use on expressways or State highway system | ||||||
| 10 | under the jurisdiction of the Department of Transportation | ||||||
| 11 | shall be taken from the Road Fund and shall be included in | ||||||
| 12 | requests for qualification processes. Any funds needed to | ||||||
| 13 | conduct the program for use on expressways under the | ||||||
| 14 | jurisdiction of the Illinois State Toll Highway Authority | ||||||
| 15 | shall be paid for by funds from the Illinois State Tollway | ||||||
| 16 | Highway Authority and shall be included in requests for | ||||||
| 17 | qualification processes. | ||||||
| 18 | (d) As used in this Section, "expressway" has the meaning | ||||||
| 19 | provided in Section 1-119.3 of the Illinois Vehicle Code.
