| 1 | AN ACT concerning safety.
| ||||||||||||||||||||||||
| 2 | Be it enacted by the People of the State of Illinois,
| ||||||||||||||||||||||||
| 3 | represented in the General Assembly:
| ||||||||||||||||||||||||
| 4 | Section 5. The Firearm Owners Identification Card Act is | ||||||||||||||||||||||||
| 5 | amended by changing Sections 5 and 7 as follows:
| ||||||||||||||||||||||||
| 6 | (430 ILCS 65/5) (from Ch. 38, par. 83-5)
| ||||||||||||||||||||||||
| 7 | Sec. 5. Application and renewal. | ||||||||||||||||||||||||
| 8 | (a) The Department of State Police shall either approve or
| ||||||||||||||||||||||||
| 9 | deny all applications within 30 days from the date they are | ||||||||||||||||||||||||
| 10 | received,
except as provided in subsection (b) of this Section, | ||||||||||||||||||||||||
| 11 | and every applicant found qualified under Section 8 of this Act | ||||||||||||||||||||||||
| 12 | by
the Department shall be entitled to a Firearm Owner's | ||||||||||||||||||||||||
| 13 | Identification
Card upon the payment of a $10 fee. Any | ||||||||||||||||||||||||
| 14 | applicant who is an active duty member of the Armed Forces of | ||||||||||||||||||||||||
| 15 | the United States, a member of the Illinois National Guard, or | ||||||||||||||||||||||||
| 16 | a member of the Reserve Forces of the United States is exempt | ||||||||||||||||||||||||
| 17 | from the application fee. $6 of each fee derived from the
| ||||||||||||||||||||||||
| 18 | issuance of Firearm Owner's Identification Cards, or renewals | ||||||||||||||||||||||||
| 19 | thereof,
shall be deposited in the Wildlife and Fish Fund in | ||||||||||||||||||||||||
| 20 | the State Treasury;
$1 of the fee shall be deposited in the | ||||||||||||||||||||||||
| 21 | State Police Services Fund and $3 of the fee shall be deposited | ||||||||||||||||||||||||
| 22 | in the
State Police Firearm Services Fund. | ||||||||||||||||||||||||
| 23 | (b) Renewal applications shall be approved or denied within | ||||||||||||||||||||||||
| |||||||

| 1 | 60 business days, provided the applicant submitted his or her | ||||||
| 2 | renewal application prior to the expiration of his or her | ||||||
| 3 | Firearm Owner's Identification Card. If a renewal application | ||||||
| 4 | has been submitted prior to the expiration date of the | ||||||
| 5 | applicant's Firearm Owner's Identification Card, the Firearm | ||||||
| 6 | Owner's Identification Card shall remain valid while the | ||||||
| 7 | Department processes the application, unless the person is | ||||||
| 8 | subject to or becomes subject to revocation under this Act. The | ||||||
| 9 | cost for a renewal application shall be $10 which shall be | ||||||
| 10 | deposited into the State Police Firearm Services Fund. The | ||||||
| 11 | Illinois State Police shall notify a person who possesses a | ||||||
| 12 | valid Firearm Owner's Identification Card of the expiration of | ||||||
| 13 | his or her Card at least 90 days before its expiration. The | ||||||
| 14 | Illinois State Police shall establish and maintain an email and | ||||||
| 15 | text message notification system for persons who are applying | ||||||
| 16 | for or possess a Firearm Owner's Identification Card. In | ||||||
| 17 | addition to receiving a mail notification of the status of a | ||||||
| 18 | person's application for, renewal, suspension, or revocation | ||||||
| 19 | of his or her Firearm Owner's Identification Card, the person | ||||||
| 20 | may request email or text message, or both, notifications of | ||||||
| 21 | the status of his or her application, renewal, suspension, | ||||||
| 22 | revocation, and other notifications concerning his or her | ||||||
| 23 | Firearm Owner's Identification Card.

| 1 | Sec. 7. Validity of Firearm Owner's Identification Card. | ||||||
| 2 | (a) Except as provided in Section 8 of this Act or | ||||||
| 3 | subsection (b) of this Section, a Firearm Owner's
| ||||||
| 4 | Identification Card issued under the provisions of this Act | ||||||
| 5 | shall be valid
for the person to whom it is issued for a period | ||||||
| 6 | of 10 years from the date
of issuance, except that if a person | ||||||
| 7 | is issued a concealed carry license under the Firearm Concealed | ||||||
| 8 | Carry Act, the person may be issued a Firearm Owner's | ||||||
| 9 | Identification Card that is valid for the person to whom it is | ||||||
| 10 | issued for a period of 5 years and expires upon the expiration | ||||||
| 11 | of the person's concealed carry license. | ||||||
| 12 | (b) If a renewal application is submitted to the Department | ||||||
| 13 | before the expiration date of the applicant's current Firearm | ||||||
| 14 | Owner's Identification Card, the Firearm Owner's | ||||||
| 15 | Identification Card shall remain valid for a period of 60 | ||||||
| 16 | business days, unless the person is subject to or becomes | ||||||
| 17 | subject to revocation under this Act.

| 19 | Section 10. The Firearm Concealed Carry Act is amended by | ||||||
| 20 | changing Section 50 and by adding Section 50.1 as follows:
| ||||||

| 22 | Sec. 50. License renewal. | ||||||
| 23 | (a) This subsection (a) applies through the 180th day | ||||||
| 24 | following the effective date of this amendatory Act of the | ||||||

| 1 | 101st General Assembly. Applications for renewal of a license | ||||||
| 2 | shall be made to the Department. A license shall be renewed for | ||||||
| 3 | a period of 5 years upon receipt of a completed renewal | ||||||
| 4 | application, completion of 3 hours of training required under | ||||||
| 5 | Section 75 of this Act, payment of the applicable renewal fee, | ||||||
| 6 | and completion of an investigation under Section 35 of this | ||||||
| 7 | Act. The renewal application shall contain the information | ||||||
| 8 | required in Section 30 of this Act, except that the applicant | ||||||
| 9 | need not resubmit a full set of fingerprints. | ||||||
| 10 | (b) This subsection (b) applies on and after the 181st day | ||||||
| 11 | following the effective date of this amendatory Act of the | ||||||
| 12 | 101st General Assembly. Applications for renewal of a license | ||||||
| 13 | shall be made to the Department. A license shall be renewed for | ||||||
| 14 | a period of 5 years from the date of expiration on the | ||||||
| 15 | applicant's current license upon the receipt of a completed | ||||||
| 16 | renewal application, completion of 3 hours of training required | ||||||
| 17 | under Section 75 of this Act, payment of the applicable renewal | ||||||
| 18 | fee, and completion of an investigation under Section 35 of | ||||||
| 19 | this Act. The renewal application shall contain the information | ||||||
| 20 | required in Section 30 of this Act, except that the applicant | ||||||
| 21 | need not resubmit a full set of fingerprints. | ||||||
| 22 | (c) The Illinois State Police shall notify a person who | ||||||
| 23 | possesses a valid concealed carry license of the expiration of | ||||||
| 24 | his or her license at least 90 days before its expiration. If | ||||||
| 25 | the only reason for the revocation of a person's concealed | ||||||
| 26 | carry license is the expiration of the licensee's Firearm | ||||||
| ||||||||||||||||||||||||||
| ||||||||||||||||||||||||||
| 1 | Owner's Identification Card, the person does not have to submit | |||||||||||||||||||||||||
| 2 | a form to the Illinois State Police to conduct an investigation | |||||||||||||||||||||||||
| 3 | of the person's suitability for the issuance of a concealed | |||||||||||||||||||||||||
| 4 | carry license.

| 7 | Sec. 50.1. Email and text message notifications. The | |||||||||||||||||||||||||
| 8 | Illinois State Police shall establish and maintain an email and | |||||||||||||||||||||||||
| 9 | text message notification system for persons who are applying | |||||||||||||||||||||||||
| 10 | for or possess concealed carry licenses. In addition to | |||||||||||||||||||||||||
| 11 | receiving a mail notification of the status of a person's | |||||||||||||||||||||||||
| 12 | application for, renewal, suspension, or revocation of his or | |||||||||||||||||||||||||
| 13 | her concealed carry license, the person may request email or | |||||||||||||||||||||||||
| 14 | text message, or both, notifications of the status of his or | |||||||||||||||||||||||||
| 15 | her application, renewal, suspension, revocation, and other | |||||||||||||||||||||||||
