| 2 | AMENDMENT NO. ______. Amend Senate Bill 337, AS AMENDED, | ||||||
| 3 | with reference to page and line numbers of Senate Amendment No. | ||||||
| 4 | 3, on page 2, lines 8 and 9, by replacing "an individual" with | ||||||
| 5 | "a person or entity"; and
| ||||||
| 6 | on page 3, line 14, by inserting "under the same business name | ||||||
| 7 | or a different business name,", after "locations,"; and
| ||||||
| 8 | on page 5, line 11, by inserting "by and under which the | ||||||
| 9 | certified licensee sells, transfers, or facilitates transfers | ||||||
| 10 | of firearms", after "licensee"; and
| ||||||
| 11 | on page 10, line 13, by inserting after "years." the following: | ||||||
| 12 | "The Department may consider the revocation or suspension | ||||||
| 13 | within the context of the conduct of the certified licensee | ||||||
| 14 | within this State, the number of retail locations the certified | ||||||
| 15 | licensee or any related person or entity operates in this State | ||||||

| 1 | or in other states, under the same or different business names, | ||||||
| 2 | and the severity of the infraction leading to revocation or | ||||||
| 3 | suspension."; and

| 4 | on page 12, line 6, by inserting ", along with a written | ||||||
| 5 | statement describing the inadequacy", after "inadequate"; and
| ||||||
| 6 | on page 12, line 23, by inserting "and implement by rule", | ||||||
| 7 | after "develop"; and

| 8 | on page 13, line 14, by inserting after "Fees", "and fines | ||||||
| 9 | deposited in the Firearm Dealer License Certification Fund"; | ||||||
| 10 | and
| ||||||
| 11 | on page 13, line 18, by inserting after "location." the | ||||||
| 12 | following: | ||||||
| 13 | "The Department shall consider the number of retail locations | ||||||
| 14 | operated by the certified licensee in this State, under the | ||||||
| 15 | same or different business names, and shall set fees | ||||||
| 16 | appropriate for certifying multiple licenses operated by the | ||||||
| 17 | certified licensee. All fees and fines collected under this Act | ||||||
| 18 | shall be deposited in the Firearm Dealer License Certification | ||||||
| 19 | Fund which is created in the State treasury. Moneys in the Fund | ||||||
| 20 | shall be used for implementation and administration of this | ||||||
| 21 | Act."; and

| 3 | "Section 15-3. The State Finance Act is amended by adding | ||||||
| 4 | Section 5.886 as follows:

| 6 | Sec. 5.886. The Firearm Dealer License Certification | ||||||
| 7 | Fund."; and

| 8 | on page 27, line 16, by replacing "Failure" with "For transfers | ||||||
| 9 | of a firearm, stun gun, or taser made on or after the effective | ||||||
| 10 | date of this amendatory Act of the 100th General Assembly, | ||||||
| 11 | failure".
