AMENDMENT TO SENATE BILL 8


2    AMENDMENT NO. ______. Amend Senate Bill 8, AS AMENDED, in 
3Section 5, immediately after the sentence that ends with 
4"kept.", by inserting "This Section does not apply (i) if the 
5minor, an at-risk person, or a prohibited person gains access 
6to a firearm and uses it in a lawful act of self-defense or 
7defense of another or (ii) to any firearm obtained by a minor, 
8an at-risk person, or a prohibited person because of an 
9unlawful entry of the premises by the minor, at-risk person, 
10prohibited person or another person."; and

11in Section 90, Sec. 8, paragraph (v), after "(v) A person who 
12fails, by inserting "2 or more times"; and

13in Section 90, Sec. 8.1, subsection (d-5), by deleting "The 
14Illinois State Police shall determine whether to revoke the 
15person's Firearm Owner's Identification Card under Section 8 
16of this Act."; and

1in Section 100, Sec. 5-20, subsection (b), paragraph (C), by 
2replacing "72" with "48 72"; and

3in Section 105, Sec. 24-4.1, subsection (d), by deleting the 
4paragraph beginning "For a second or subsequent offense" and 
5ending "in subsection (c) of Section 10 of that Act."; and

6in Section 110, immediately below the last line of Sec. 5-4-1, 
7by inserting the following:

8    "Section 997. Severability. The provisions of this Act are 
9severable under Section 1.31 of the Statute on Statutes.".
