1 A bill to be entitled
2 An act relating to electronic monitoring of persons
3 charged with or convicted of offenses involving
4 schools or students; creating s. 903.0472, F.S.;
5 authorizing electronic monitoring and location
6 restrictions as conditions of pretrial release of
7 persons charged with certain offenses against schools
8 or students; creating s. 948.301, F.S.; authorizing
9 courts to order electronic monitoring and location
10 restrictions for offenders who commit certain offenses
11 against schools or students; providing an effective
12 date.

14 Be It Enacted by the Legislature of the State of Florida:

16 Section 1. Section 903.0472, Florida Statutes, is created
17 to read:
18 903.0472 Additional terms and conditions for certain
19 offenses involving schools and students.—In addition to the
20 requirements of s. 903.047, as a condition of pretrial release,
21 whether such release is by surety bail bond or recognizance bond
22 or in some other form, a defendant charged with a violation of
23 s. 790.115, s. 790.161, s. 790.1615, s. 790.162, s. 790.163, s.
24 790.164, s. 790.165, s. 790.166, s. 810.095, or s. 836.10
25 committed against a public or private school, as defined in s.
26 1003.01(2), or a student in such a school, may be required to be
27 electronically monitored as a condition of pretrial release and
28 prohibited from being within 1,000 feet of any public or private
29 school.
30 Section 2. Section 948.301, Florida Statutes, is created to
31 read:
32 948.301 Additional terms and conditions for certain
33 offenses involving schools and students.—Effective for
34 probationers or community controllees whose crime was committed
35 on or after October 1, 2023, and who are placed under
36 supervision for a violation of s. 790.115, s. 790.161, s.
37 790.1615, s. 790.162, s. 790.163, s. 790.164, s. 790.165, s.
38 790.166, s. 810.095, or s. 836.10 committed against a public or
39 private school, as defined in s. 1003.01(2), or a student in
40 such a school, the court may, in addition to all other standard
41 and special conditions imposed, require mandatory electronic
42 monitoring and prohibit the probationer or controllee from being
43 within 1,000 feet of any public or private school as a condition
44 of the probation or community control supervision.
45 Section 3. This act shall take effect October 1, 2023.
